2. Client Responsibilities
- Content Submission: You are responsible for providing all necessary text, images, and other content required for your website in a timely manner, unless copywriting or asset creation is explicitly included in your selected package.
- Communication: Timely feedback and approvals are required to keep the project on schedule. Delays in client feedback may result in corresponding extensions to the project timeline.
- Ownership & Rights: You affirm that you own or have the right to use all materials and content you provide to us for inclusion in your website.
3. Payments and Billing
Our pricing structure typically includes upfront deposits or milestone-based payments, as detailed in your specific quote or package selection (e.g., Starter, Growth, or Web App plans).
- All invoices must be paid according to the terms specified on the invoice.
- Work may be paused if payments are not received by the agreed-upon deadlines.
- Once a project has commenced, initial deposits are generally non-refundable to cover the time and resources already committed.
4. Intellectual Property
Upon final payment and completion of the project, all rights to the custom design and code specific to your project will be transferred to you, except where third-party licenses, open-source software, or proprietary agency tools and templates are utilized. DreamSite Builders reserves the right to showcase the completed work in our portfolio, case studies, and marketing materials unless a non-disclosure agreement is explicitly signed.
5. Warranties and Liability
- As-Is Service: While we strive to produce high-quality, bug-free websites, digital products are provided "as is" and "as available" without any warranties, express or implied.
- Third-Party Services: We are not responsible for the uptime, performance, or changes to policies of third-party services integrated into your website (e.g., hosting providers, payment gateways, CMS platforms).
- Limitation of Liability: In no event shall DreamSite Builders be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of our services or the resulting website.
6. Revisions and Maintenance
Project packages include a specified number of revision rounds during the development phase. Once the site is launched and approved, any additional changes, feature additions, or ongoing maintenance may be subject to separate hourly rates or maintenance contracts unless explicitly included in your service package.
7. Termination
Either party may terminate a project with written notice if the other party breaches these Terms and fails to cure the breach within a reasonable timeframe. If a project is terminated early by the client, DreamSite Builders retains the right to bill for all work completed up to the date of termination.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DreamSite Builders primarily operates, without regard to its conflict of law provisions.
